Diamond J Horses acts as an agent for the seller and the buyer. We expect all sellers to disclose any and all health and/or behaviors issues with each horse listed for sale. Such disclosure is due, in writing, when the seller submits the description of the horse they list for sale. If a seller has more than one (1) horse, such seller shall provide a separate description and full disclosure for each horse. This is to inform all prospective buyers and maintain honesty and integrity for our auctions. Should a buyer encounter an issue with a horse they have purchased, such buyer needs to contact the seller. Diamond J Horses is not liable for any issues resulting from a non-disclosed issue with any animal sold at any of our auctions. We will, if needed, act as a 3rd party mediator. Jurisdiction for any legal action shall be within the state where the auction was held. The laws of the State in which the sale is taking place govern all transactions between buyer, consignor and Auction Company.
Further, Auction Company makes no representation as to the pregnancy, foaling or fertility of any horse sold at auction. Final pregnancy status of broodmares will be announced at the auction block by the cosigner or representative and will take precedence over printed material for that particular horse. Broodmares represented as being “in foal” are subject to a pregnancy examination by the Official Sale Veterinarian immediately upon exit from the auction arena and at buyer’s expense. If no such examination occurs prior to the mare leaving the auction grounds and is later found to be open, no right of recourse can occur.
Any contractual agreements between a buyer and the consigner of a broodmare or stallion are strictly between the consigner and buyer and the Auction Company shall not be liable for any such contract in the event of breach by either party.
All original registration certificates, transfer reports and/or applicable breeder certificates and/or registration applications and/or brand certificates, etc., shall be provided to the Auction Company during the check-in process. All consignments are required to be registered. Consigners guarantees the identity of each animal as it appears on the registration certificate. Auction Company and its employees make NO guarantee regarding the paperwork of any horse selling on breeder’s certificates and/or registration applications and are not liable for any damages to any person or entity in regards to such issues.
No horse shall be sold without the applicable documentation as specified herein.
All horses will be shown in the preview the day of the auction and all horses are expected to walk, trot and canter in both leads. All other horses led through the sale will walk and trot in the preview.
All documentation related to a particular horse will be held by the Auction Company until all forms of payment from buyers has cleared the buyer’s financial institution. Upon payment clearance, all applicable paperwork will be forwarded promptly and directly to the buyer. If buyer is paying in cash, all documentation related to that horse will be provided to buyer at the time of the cash transaction. Buyer is solely responsible for any and all transfer and/or registration fees.
We hold any and all commission checks for a period of forty-eight (48) hours before dispersing funds.
We also have a zero tolerance drug policy for all horses listed for sale. Full disclosure of any and all medications, including, but not limited to, deworming, behavior medications, ointments, special supplements, shots, antibiotics, etc. All horses in any sale must have been tested with a negative result for equine infections anemia (coggins test) within six (6) months prior to auction. AGID tests will allow an animal entry into Canada and health chart must also be provided within 30 days prior to the auction. Out of State or other health certificates may be obtained from the official sale veterinarian and are at the expense of the buyer in accordance with the regulations of the State Animal Health Control agency in the state where the auction occurs.
Buyers and Spectators are cautioned to be careful while on the auction grounds. Diamond J Horses and all employees thereof, inclusive of management, shall not be responsible for any injuries to persons or property on the grounds. Attendance at any auction, in any capacity, shall be considered a waiver of any and all claims against Diamond J Horses for any claims for personal injury and/or property damage.
PROSPECTIVE BUYERS ARE ADVISED BY THE AUCTION COMPANY TO THOROUGHLY EXAMINE AND INSPECT ANY HORSE PRIOR TO BIDDING AND/OR PURCHASE. HORSES ARE SOLD “AS IS” AND THERE ARE NO WARRANTIES OR GAURANTEES OF ANY KIND REGARDING THE FITNESS, DISPOSITION, PHYSICAL CONDITION, HEALTH, ETC.
Buyers have ample time to inspect any and all horses they are interested in as well as time to communicate with any cosigners prior to sale times. We encourage you to do so. A buyer may also, at buyers sole expense, have an animal checked by a veterinarian on the sale grounds and prior to the animal going into the sale arena.
Buyers are required to provide Diamond J Horses with a current and valid driver’s license, current telephone number, street address and email address.
The highest bidder will be considered the buyer. All successful buyers shall sign a Buyer’s Agreement which will be presented by an auction clerk immediately after the purchase is made. In the case of an online purchase, the Buyer’s Agreement will be emailed to such buyer.
The Auction Company and/or Auctioneer reserve the right to reject any and all bids. This would include bids made by persons or entities that have defaulted on any prior bids or sales from any prior auctions. Should a dispute arise between 2 or more bidders, the dispute shall be settled by the Auctioneer and the Auctioneer’s decision shall be deemed full and final settlement of such dispute. The right to re-purchase or pass-out (“P.O.”), is reserved by the consigner or the representative of such. Any such action must be made prior to the horse leaving the departing the auction arena.
The Auction Company is NOT responsible for any bid that is not honored. If such occurs, the seller agrees to hold the Auction Company harmless therefrom, including any of the Auction Company’s employees, managers, owners, etc.
Horses are subject to applicable state sales tax. Taxes shall be paid by the bidder/buyer at the time the purchase price is paid. Horses that are exempt from such state sales tax, shall be deemed such by the seller providing any and all documentation (i.e. sale certificates of exemption) supporting a tax exempt status. Such documentation shall be in form as required by the Department of Revenue. The Auction Company will have available exemption forms and instructions for same in the sales office to be executed by the buyer at the time of settlement.
“Title” of any horse passes to the buyer at the time of the final fall of the Auctioneer’s gavel unless a repurchase or pass-out is clearly indicated immediately by the cosigner or their agent or the Auctioneer. The buyer assumes “title” and all associated risks, expenses and responsibility at such time regardless of whether physical delivery of the horse has been made. No delivery shall be made until full and final financial settlement is completed with the sales cashier. Once a horse has been delivered to buyer, buyer must remove the horse from the grounds within the pre-designated time (announced at the beginning of the auction). Failure by the buyer to do so may result in buyer being responsible for any charges associated with the purchase. Buyers are solely responsible for the supervision and care of the purchased horse while on the auction grounds after sale and are encouraged to make arrangements with the cosigner for such care if an animal cannot be moved in a timely manner.
Sale terms are to be payment in full, inclusive of any applicable sales tax, must be paid directly to the sale cashier during or immediately after sale. Cash, personal checks, cashier’s check, traveler’s checks (approved) and major credit cards (Visa, MasterCard, Discover and American Express) are accepted. All personal checks shall be verified with a current and valid driver’s license. An additional fee of 3% shall be paid as an office processing fee for all non-cash transactions. Cash transactions shall have a discounted office processing fee.
